Article 1 — Definitions

In these Terms of Service, the following terms shall have the following meanings:

Business operator: Imperial Capital Partners, which operates the online store tauchic.dk.

Consumer: any natural person who makes a purchase on our online store for purposes unrelated to their business activities.

Agreement: any agreement entered into between TAUCHIC and the consumer via the online store tauchic.dk.

Cancellation period: the period during which the consumer may exercise their right of cancellation.

Durable medium: any medium that enables the consumer to store information addressed personally to him in a way that allows for future reference.

Article 3 — Applicability

These Terms of Service apply to all offers from TAUCHIC and to all agreements entered into between TAUCHIC and the consumer via tauchic.dk.

Before the contract is concluded, the text of these terms of service will be made available to the consumer. If this is not reasonably possible, it will be indicated where the terms of service can be viewed before the contract is concluded, and that they will be sent free of charge as soon as possible upon the consumer’s request.

If the agreement is concluded electronically, the text of these terms of service may be sent to the consumer electronically in a manner that allows them to be easily stored on a durable medium.

Article 4 — The Offer

If an offer has a limited validity period or is subject to conditions, this will be clearly stated.

The offer contains a complete and accurate description of the products offered. The description is sufficiently detailed to allow the consumer to make a proper assessment of the offer. Product images are a true representation of the products offered. Obvious errors or obvious omissions in the offer are not binding on TAUCHIC.

Each offer must include information that makes it clear to the consumer what rights and obligations are associated with accepting the offer.

Article 5 — The Agreement

The agreement is concluded when the consumer accepts the offer and fulfills the associated conditions.

If the consumer has accepted the offer electronically, TAUCHIC will immediately confirm receipt of the acceptance of the offer electronically. Until TAUCHIC has confirmed receipt of this acceptance, the consumer may cancel the contract.

TAUCHIC takes appropriate technical and organizational measures to ensure the secure electronic transmission of data and maintains a secure web environment. If the consumer is able to pay electronically, TAUCHIC will take appropriate security measures.

Article 6 — Right of Withdrawal

When purchasing products, the consumer has the right to cancel the contract without giving any reason within 30 days. This period begins on the day after the product is received by the consumer or a representative designated in advance.

During this period, the consumer must handle the product and packaging with care. He may only unpack or use the product to the extent necessary to assess whether he wishes to keep the product. If they exercise their right of withdrawal, they must return the product to TAUCHIC with all accessories provided and—if reasonably possible—in its original condition and packaging.

Article 7 — Costs of Cancellation

If the consumer exercises their right of withdrawal, the cost of return shipping will be borne by the consumer at most.

If the consumer has paid an amount, TAUCHIC will refund that amount as soon as possible and no later than 14 days after the return or cancellation.

Article 8 — Exceptions to the Right of Withdrawal

TAUCHIC may exclude the right of withdrawal for certain products. The exclusion of the right of withdrawal applies only if TAUCHIC has clearly stated this in the offer, at least well in advance of the conclusion of the contract.

The right of withdrawal may be excluded only for the following products:

  • created by TAUCHIC in accordance with the consumer's specifications;

  • which are clearly of a personal nature;

  • that cannot be returned due to their nature;

  • that can quickly spoil or become outdated;

  • that have been opened or used for hygiene reasons;

  • digital content supplied on non-tangible media (after the consumer has given their prior consent).

Article 9 — Prices

During the promotion period, the prices of the products on offer will not be increased, except as a result of changes in the sales tax rate.

The prices listed in the product offer include VAT.

Article 10 — Warranty and Compliance

TAUCHIC warrants that the products comply with the agreement, the specifications set forth in the offer, reasonable requirements regarding reliability and/or fitness for a particular purpose, and, as of the date of the agreement, applicable laws and/or government regulations.

Under Danish consumer law, you have the right to file a complaint for up to 24 months. These rights are not affected by this warranty.

Article 11 — Delivery and Performance

TAUCHIC will exercise the utmost care in receiving and fulfilling orders for products.

The delivery address is the address that the consumer has provided to TAUCHIC.

The maximum delivery time is 30 days after the order is placed, unless a longer delivery time has been agreed upon. If delivery is delayed, the consumer will be notified no later than 30 days after placing the order. In such cases, the consumer has the right to cancel the agreement at no cost and is entitled to compensation, if applicable.

The risk of damage and/or loss of the products remains with TAUCHIC until the time of delivery to the consumer or to a representative designated and identified in advance, unless otherwise expressly agreed.

Article 12 — Subscriptions and Ongoing Agreements

The consumer may terminate an agreement entered into for an indefinite period for the regular delivery of products at any time, subject to the agreed termination rules and a notice period of no more than one month.

A fixed-term contract cannot be automatically renewed without the consumer’s express consent.

Article 13 — Payment

The consumer must pay the amounts due within 14 days of the conclusion of the agreement, unless otherwise agreed.

The consumer is required to immediately notify TAUCHIC of any inaccuracies in the information provided or recorded in connection with the payment.

In the event of non-payment by the consumer, TAUCHIC is entitled to charge reasonable costs, which the consumer has been informed of in advance, subject to any legal limitations.

Article 14 — Complaints and Claims

TAUCHIC has a well-documented complaint procedure and handles complaints in accordance with this procedure.

Complaints regarding the performance of the agreement must be submitted to TAUCHIC in full and clearly described within a reasonable time after the consumer has discovered the defect.

Complaints submitted to TAUCHIC will be responded to within 14 days of receipt. If a complaint requires a longer processing time, TAUCHIC will respond within 14 days with an acknowledgment of receipt and an indication of when the consumer can expect a more detailed response.

Article 15 — Governing Law and Disputes

Agreements between TAUCHIC and the consumer to which these Terms of Service apply are governed exclusively by Danish law.

Disputes between the consumer and TAUCHIC concerning the formation or performance of agreements relating to products to be delivered or supplied by TAUCHIC may be brought before a competent Danish court.

Article 16 — SMS and email marketing
